Protecting human and environmental health with Safer Products for WA

Many of the products we use on a daily basis contain toxic chemicals that escape into our homes and the environment when we use and dispose of them. Even small amounts of chemical releases are steady, and when combined, they make up one of the biggest sources of toxics entering Washington’s environment.

New law

In spring 2019, the Washington Legislature passed a law that creates a new way to keep toxic chemicals out of consumer products. Ecology named the law’s implementation program Safer Products for Washington.
It directs us to work with Department of Health to:

·       Choose priority chemicals.
·       Identify products that contain these chemicals.
·       Decide whether or not to regulate those chemical-product combinations by requiring reporting or chemical restrictions.
·       Adopt rules to implement those regulatory actions.
Our team in the Hazardous Waste and Toxics Reduction program has been collaborating with statewide partners, diving into the research, and hearing from stakeholders to implement this law.

Why it matters

The law has important consumer impacts—especially for sensitive populations like our children. We all benefit from the convenience and services of consumer products. But those products shouldn’t harm us, our kids, or our environment.
In Washington, millions of dollars have been spent removing toxics from contaminated water bodies, yet some fish are still unsafe to eat and sensitive species like our orcas continue to dwindle due, in part, to chemical contamination.
Under Safer Products for Washington, we can make consumer products safer. It’s the right thing to do to protect the future of Washington’s residents and wildlife.

What’s new

In partnership with Department of Health, we released a draft report that identifies nine consumer products for further evaluation and potential rulemaking. The report release started a 45-day public comment period that ends March 2, 2020.

In the report, we proposed these priority products:

·       Carpet and aftermarket carpet treatments containing PFAS (per- and polyfluoroalkyl substances).
·       Vinyl flooring and cosmetic fragrances containing phthalates.
·       Laundry detergent, thermal paper, and food cans containing phenolic compounds.
·       Printing inks containing PCBs (polychlorinated biphenyls).
·       Electric and electronic equipment containing organohalogen flame retardants.

Why we’re looking at these products

We chose these consumer products because research demonstrates that they are exposing people and the environment to priority chemicals. We evaluated reports from Health and Ecology, research from Ecology’s product testing program, and peer-reviewed literature.
When the public comment period ends, we will evaluate the feedback and finalize this list of products. Then, we’ll begin the research to identify whether safer alternatives are available, and to determine regulatory actions, if any.

Do the Earth a favor – clean up and prevent pollution

Earth Day is fast approaching, so let’s talk about Washington‘s dirty little secret.

Well, maybe it’s not exactly a “secret.” And it sure isn’t “little.” But chances are most of the state’s residents don’t realize Washington is literally littered with polluted properties.

Specifically, 12,359 toxic sites. And those are just the ones we know about right now. More are reported to us each year, even as others are cleaned up. So far, just over half of them are considered to be “cleaned up.” But there is still a long way to go.

Environment, Economy, Community


The state’s basic stance is “the polluter pays.” But that’s not always possible – the current landowner may not have caused the pollution and doesn’t have the money to pay for cleanup.

The bottom line is that someone has to clean up the pollution. Allowing it to languish poses risks to people who could be exposed to it, impacts the environment and wildlife, and stalls potential redevelopment that could benefit local communities.

Cleanup is all about “environment, economy, community” – cleaning up contamination provides short-term and potential long-term economic benefits while protecting the health of people and the environment. That all adds up to an improved quality of life for communities.

A healthy economy also can contribute to cleanup – developers or local governments see a potential return on a piece of property they own or buy, so cleaning it up pencils out for them in the long run.

Cleanup, prevention go hand in hand


But cleanup isn’t cheap, and it doesn’t happen quickly. Cleanup isn’t simply a matter of digging up contaminated dirt on land or dredging contaminated muck out of the water. A lot of engineering, science and legal steps are needed to get to the actual cleanup work, and those steps can take years. Total cleanup costs could add up to tens of millions of dollars for just one site.

Cleanup is worth the investment. But so is prevention – and prevention is generally cheaper and simpler than cleanup.

Prevention means reducing the toxics used in manufacturing, finding safer substitutes for chemicals in products, and stopping toxics before they escape into the environment.

For example, Ecology is working with brake manufacturers to phase out the use of copper in the brake pads used on cars and trucks. Cutting copper won’t affect the brakes’ cost or performance. But it will reduce the amount of copper pollution reaching our rivers, lakes and Puget Sound, where it is toxic to salmon and other species.

Cleanup and prevention go hand in hand – cleanup without prevention means sites will face recontamination issues, and maybe repeated, expensive cleanups. And prevention without cleanup means that decades-old pollution remains in place, threatening the health of Washington’s people and environment.

Hazardous waste: Out of sight, out of mind?

Ecology hazardous waste inspector challenges all of us to think again

It’s easy to go about your day and not think about hazardous waste disposal—out of sight, out of mind, right? But it’s important to step back every so often and think about how we as a community, and as individuals, generate and manage our waste.

And more importantly ask, can we do a better job?

Mindy Collins, hazardous waste compliance inspector in Ecology’s Bellingham office, has thought about waste almost every day of her 20-year environmental career, which has largely focused on waste disposal and management.

Collins is part of Ecology’s Hazardous Waste & Toxics Reduction team. Her job is to help businesses figure out how to better manage the waste they generate. (And save money along the way.)

Sometimes that means reducing waste through innovation. Other times that means changing disposal methods. But before she can do any of that, she has to learn about their business, their products and the processes that create waste.

“I feel so lucky,” said Collins. “I get to talk to people about their businesses, and learn about their products. The stories I get to hear about the history of the company, or how they started making a product—it’s just fascinating.”

Different businesses, common concerns

You might be surprised to learn the wide range of businesses and organizations that generate hazardous waste. Big box stores, hospitals, universities, and even art studios, to name a few.

Collins typically visits businesses that generate a significant volume of hazardous waste—220 lbs or more of waste per month—or those that need additional help managing it. In the last year, she visited a boat builder, wood treatment facility, aerospace manufacturer, pharmaceutical manufacturer, a company that makes fishing lures, and a company that makes orthotics for children.

“There’s one commonality in all of these vastly different companies,” Collins said. “Business owners are busy. And let’s face it, environmental regulations can be confusing—especially to someone who doesn’t work with them every day. I really enjoy helping people navigate the process.”

She looks at how wastes are stored, and whether there are any risks to human health or the environment. Are the containers appropriate, and in good condition? Are they labeled correctly? Is there a spill response plan? She also looks at the company’s waste disposal records to see what is going where. Each industry and business has its own set of challenges and complexities, but success stories abound.

Putting business practices to good use

Earth Day is less than two weeks away, making April a great month to look inward and refocus our own daily habits. How can we take a Mindy Collins approach to household waste? What ingredients make up the products we use? How should they be safely disposed? What are we throwing away that could be put to better use?

Most of us lead busy lives and changing habits is difficult—especially when we don’t have an environmental consultant to guide us. So we’ve culled our online resources to help you.

Tools to reduce, manage, and safely dispose of household waste:

1.) Be curious. We have a team of people that test consumer products to ensure that manufacturers are complying with restrictions and reporting requirements. You can read these reports, or search for information on individual products.

2.) Choose safer products. We’ve compiled a list of great resources for shoppers looking for safer, greener products. EPA also has an interactive tool to help find better products for the home, school, office and more.

3.) Think before you buy, or throw away. Adhesives, degreasers, toilet cleaners, batteries, and paint are among the many hazardous wastes that are common in households. Choose alternative products, buy in small quantities, and safely dispose at a hazardous waste collection site.

4.) Recycle fluorescent lights. The LightRecycle Washington program helps Washington residents and businesses recycle fluorescent and mercury-containing lights for free.

5.) Recycle electronics. E-Cycle Washington is a successful program that helps keep old electronics, which may contain toxic materials, out of our landfills. Bring televisions, computers, monitors and tablets and more to an e-Cycle location in your area.

Tough love for teddy


A teddy bear with its head ripped open. A squishy child’s toy, cut to ribbons. A heart-shaped box, crushed.

This isn’t a Valentine’s Day massacre – it’s the tough love our product testing team gives to the toys, knickknacks, and assorted endearments that line store shelves this time of year.  They may look adorable, but some of these items may contain lead, phthalates, or other toxic chemicals that manufacturers are required to report under Washington’s Children’s Safe Product Act.

Why seasonal items?
Because holiday items arrive in a rush and disappear just as quickly, they raise special concerns for protecting children. Testing lets us know whether manufacturers are following state laws. 

The presence of a chemical in a product does not necessarily mean it’s unsafe. However, some chemicals have been banned for specific uses because they pose special concerns, such as lead in packaging.

Tests show most manufacturers are following laws that regulate the use of toxic chemicals. When Ecology finds a chemical in a product that is banned or requires reporting, we notify the manufacturer and work to bring them into compliance. If necessary, Ecology may have to issue a financial penalty to ensure that companies comply with the law. 

Testing, testing, testing
In the product testing facility at Ecology’s Lacey building, holiday products are sorted, screened and processed. An X-ray fluorescence analyzer, or XRF, is used to screen the items for heavy metals and other elements. Those that may contain chemicals of concern are sent to a laboratory for an analysis of their chemical ingredients.

Unfortunately, this processing and analysis takes some time, so most of today’s Valentine mementos will be memories by the time Ecology issues its product testing report later this spring. However, the test results give us and other state agencies the data they need to work with retailers and manufacturers in time for future holidays.

So all of that slicing and dicing is for a good cause in the end -- even if it is a little rough on Teddy.

Tackling Toxics: How do we really know a chemical is safe?

We all want safer products. No one ever argues in favor of putting hormone disruptors in children’s toys or substances toxic to fish in tires.

But when an inventor or manufacturer is designing a product, how do they really know what chemical ingredients are safe? Asbestos was considered a safer alternative when it was introduced. And “safe” compared to what? Pesticides are not supposed to be safe – for bugs. And how do they prove it?

Chemical hazard assessments

This is where chemical hazard assessments come in. A chemical hazard assessment is a tool to help organizations evaluate a chemical’s impact on human health and the environment. The key component of a chemical hazard assessment is that it enables the user to compare chemicals against each other on a level playing field.

The GreenScreen® for Safer Chemicals method, for instance, ranks a chemical on 18 different potential impacts on human health and the environment. Running a GreenScreen assessment will tell you things like whether a given chemical can cause cancer, or if it’s flammable, or whether it’s safe for fish.

Several major manufacturers and retailers use GreenScreen or similar systems to screen the ingredients that go into their products. These companies go to their suppliers and say, “show us that your chemical is safe.”

However, a full GreenScreen report can run more than 20 pages – just for a single chemical. Sometimes that’s too much, particularly for smaller businesses or if a company is just doing a preliminary assessment.

Quick Chemical Assessment Tool

To meet this need, we developed a simpler method, the Quick Chemical Assessment Tool, or QCAT. It’s based on GreenScreen and uses the same databases of chemical hazards, but it looks at a smaller set of potential health and environmental endpoints. A QCAT report is about five pages long.

Still too much? There are a number of chemical hazard databases, such as Pharos, that are inexpensive to use and will give a quick rundown on potential problems in just a few seconds.

Tackling Toxics: Searching for safer products?

The EPA can help

One of the simplest things we can do to protect the environment, both at home and at our workplaces, is to use safer chemicals in our cleaning supplies and other household products.

But how do you know what “safer” is? Do you look for “natural” on the label? Should it say “eco” in the name? There are more than 300 different “green” certifications. Which one should you trust?

If you really want to pick the safest products possible, a great place to start is the U.S. Environmental Protection Agency’s Design for the Environment program.

Design for the Environment is a voluntary product labeling program that works with manufacturers to determine that the chemicals used in a product are the very safest available. Today, more than 2,500 products ranging from toilet bowl cleaners to bilge tank treatments have been evaluated through the Design for the Environment Safer Product Labeling Program.

The Design for the Environment label means that each ingredient has been screened for potential adverse human or environmental health effects and that the product contains ingredients that pose the least concern among chemicals in their class. You can find a list of all 2,500 products, organized by category, or you can look for the Design for the Environment logo on the products you already buy.

Tackling Toxics: PCB problem requires creative solutions

You would think that a toxic substance we stopped using 35 years ago would no longer be a problem, right? Wrong.

Polychlorinated biphenyl (PCB) contamination is widespread throughout Washington and found in almost every water body in the state.

History of PCBs

PCBs were produced for commercial uses from about 1929 to 1977. During this time, PCBs were widely used for heat transfer fluids in electrical transformers and capacitors. They were also used as plasticizers, wax and pesticide extenders, and lubricants. Many common products used to contain PCBs at high levels, such as carbonless copy paper and caulk used to seal cracks in homes and buildings.

As early as 1936, serious skin irritations and other health effects were noted in industrial workers exposed to PCBs, which led to increased protection for workers but didn’t slow their manufacture. By 1976, it was clear PCBs were also an environmental problem. The Toxic Substances Control Act (TSCA) was passed to ban the majority of PCB uses and restrict remaining concentrations to low levels. This law was in effect by 1979.

Health & environmental effects


Unfortunately, PCBs last for a very long time in the environment. This is a concern not only for plants and animals, but also for humans. PCBs have toxic effects to the immune, reproductive, nervous, and hormone-regulation systems in humans and other living things. PCBs cause cancer in animals and are considered likely to cause cancer in humans.

PCBs also build up in living things, which is amplified when predators eat prey (known as biomagnification, see illustration, courtesy of the Seattle Post Intelligencer). For example, the Washington Department of Health has set fish advisories for many bodies of water due to PCB and other contamination. When a person eats fish that’s been living in waters contaminated by PCBs, that contamination then enters her body and adds to the store she already may have from other exposures – like consumer products.


Breaking the law?

PCBs continue to show up in products today because manufacturing them at low levels was not outlawed by TSCA. They are often inadvertently produced during manufacturing processes, especially those including pigments or dyes. Concentrations in each product are low. However, the large numbers of products that contain PCBs add up to significant, problematic releases to the environment.

The results are in: PCBs in consumer products

We recently tested 68 consumer products and confirmed that PCBs are present in commonly used items. Forty-nine, or 72 percent, of the products contained at least one of four PCB types. We ran the tests to gauge PCB levels in consumer products and potential releases to Washington’s environment.

Items tested in our study include paper products, paints and colorants, caulking, printer ink, and some product packaging. Full details – including a complete product listing – are available in a report on Ecology’s website. The study focused only on four PCB types that previous studies have linked to pigments and dyes. A future report will include results for all 209 PCB types.

We have already begun a second round of testing for PCBs in consumer products with a focus on yellow, green and blue paints and colorants, colored clothing, cosmetics, soaps, office products and products used by children, such as fingerpaints and comic books. Some of this testing will help state agencies comply with a new law requiring agencies to only buy PCB-free products.

PCBs affect water quality

Gov. Inslee’s Clean Water Initiative to update water quality standards and reduce toxic threats includes PCBs as a key chemical of concern. Contamination levels are high enough to require cleanup plans in several areas, including the Lower Duwamish Waterway, Spokane River, Wenatchee River, and Lake Washington. Ecology also found elevated PCB levels in the Puget Sound basin and estimated releases as part of the Puget Sound Toxics Assessment.

PCBs in consumer products are also making it difficult for some companies to meet their water quality discharge limits. For example, a large paper recycler in the Spokane area is having trouble meeting its water discharge limits because of PCB contamination in a lot of the products it recycles, including newspaper and consumer product packaging. If we can help get rid of PCBs in these products, it benefits not only the environment but industry as well.

Honoring champions of safer products and cleaner manufacturing

Safer chemistry will take center stage in October when the Washington Department of Ecology joins Northwest Green Chemistry to present the Safer Chemistry Champion Awards.

The awards, which will be presented during the Northwest Green Chemistry Roundtable Oct. 28 in Tacoma, honor businesses and organizations committed to creating safer products and finding cleaner manufacturing methods. Finding ways to eliminate hazardous chemicals in the design stage or the manufacturing process means fewer toxic cleanups, healthier communities and a cleaner environment.

Nominations are open to companies, nonprofit organizations, governmental organizations and educational institutions for achievements in green chemistry, hazardous materials reduction and sustainability. Nominations are due by Sept. 8.

The Safer Chemistry Champion Awards are part of our Safer Chemistry Challenge program, which is working to promote innovation and best practices in the Northwest.

Ecology Experts Assist Craft Brew Alliance to Produce Better Beer with a Better Bottom Line

Most breweries are focused on getting product out the door. They have little time to consider what their wastes are costing them.

Craft Brew Alliance (CBA) is trying a new approach with the help of Ecology’s Technical Resources for Engineering Efficiency (TREE) team. CBA’s sustainability manager Julia Person asked us to assist her team in cutting waste and increasing efficiency. The goal was to eliminate as much waste as possible, while becoming more productive and continuing to produce great libations.

CBA is the merger of leading Pacific Northwest craft brewers: Redhook Brewery, Widmer Brothers Brewing, and Kona Brewing Company. Together they aim to preserve and grow one-of-a-kind craft beers and brands. The TREE team focused on the Redhook Brewery in Woodinville. The facility’s expansive grounds host many events and include a tasting room and a full-service restaurant. Redhook wanted to improve their solid waste handling and recycling.

Cutting waste and increasing energy efficiency saves money

Our TREE team visited Redhook several times (at no charge to the company) and suggested a number of ways to reduce waste and save money. One was to carefully separate bottles, cans, and other recyclables from solid wastes coming out of the restaurant.

But the brewery also had high surcharges on their sewer bill due to excessive organic material in their discharge. Breweries struggle with this type of waste because their discharges contain expired beer product, spent grain liquids, and other brewery liquids. The trick was figuring out how to better manage these wastes. We recommended diverting spent yeast, grains, and liquids from the sewer, and instead providing them to local dairy farms for cattle feed. This got the organic materials out of their discharges and ended the high sewer surcharge.

Ecology audit identifies waste

To help Redhook with energy costs, the TREE team conducted an audit of machinery on their production line. We used an infrared device to find compressor air leaks and motors not functioning efficiently. The air leak audit found 48 leaks costing the company about $19,000 each year in electricity. The motor function audit found 18 motors and 20 gear boxes running hotter than normal.

Fixing these problems will save the brewery about 216,531 kilowatt hours per year and cut more than 17,000 pounds of greenhouse gas emissions - in addition to the money saved.

Redhook boasts impressive results. So far, they:
  • Reduced the costs of both sewer and electricity.
  • Eliminated the water-soap mixture used to move bottles in favor of a liquid-free bottling line. This is expected to bring an even larger drop in water usage and sewer fees.
  • Educated others by hosting a workshop to share what they learned. They also helped other breweries connect with resources throughout the Northwest Region, such as our TREE team and the Pollution Prevention Resource Center.
CBA is applying the improved practices they learned from Ecology’s TREE team to their other brewery facilities. And they’re discovering more improvements and innovations on their own. They realize cutting waste and conserving water and energy are big money savers and good for business. Beer drinkers can toast to that!

Tackling Toxics: Flame Retardants

Are they worth the risks?

Flame retardants are one class of chemicals the Department of Ecology is tracking. Many of these chemicals are toxic, and some are also persistent, bioaccumulative toxics (PBTs) because they gradually increase and remain in the environment and our bodies over time.

Evidence is mounting that shows flame-retarding chemicals don’t effectively slow fires and that fire fighters can have negative health effects from inhaling their fumes while battling blazes. (See The Chicago Tribune series “Playing with Fire” for more information.)

PDBEs are everywhere

Polybrominated diphenyl ethers (PBDEs) are one type of chemical flame retardant that manufacturers have added to a variety of consumer products for over 30 years to slow combustion. Studies show that PBDEs, which are persistent and bioaccumulative, can impact reproductive health, the immune system, and development in mammals. They are escaping from consumer products and building up in people and the environment throughout the world. PBDEs have been found in human breast milk, blood and fat; house dust and indoor air; fish; wildlife; birds; beef; dairy products and sediments.

Three PBDE mixtures were widely used for different purposes. Penta-BDE was used in low-density polyurethane foam in products such as furniture. Octa-BDE was used in electronics, such as housings for fax and answering machines, automobile trim, telephone handsets, and kitchen-appliance casings. Deca-BDE was used primarily in electronic enclosures, particularly in computers and televisions.

Prevention is the cure

In 2007, Washington banned the use of penta- and octa-BDE in products sold in the state. The use of deca-BDE was also banned in mattresses at that time, and that ban was extended to televisions, computers, and residential upholstered furniture after Ecology found safer alternatives.

We also track the use of 66 chemicals of high concern to children (CHCC), including six flame retardants. Manufacturers report their use of CHCCs if they are present in children’s products under the Children’s Safe Product Act (CSPA).

Over the last year, Ecology tested 125 consumer and children’s products for PBDEs to ensure manufacturers and retailers are complying with the ban and reporting under CSPA. Products tested include seat cushions, mattresses, upholstered furniture for children, electronics, clothing, and baby carriers.

Finding these chemicals is like being a detective. Unfortunately, analyzing samples to isolate specific substances is not as quick and easy as it may appear on slick crime-scene-investigation TV shows. To select products for testing, Ecology staff purchased items that were likely treated with flame retardant chemicals. Products were then scanned for indicators of flame retardants using x-ray fluorescence. If the scan results were positive, the product was then broken into separate components, such as fabric, stuffing, foam, metal and plastic, and sent to a lab for analysis.

So what did we find?

An unfortunate side effect: Regrettable substitutions

The good news is we didn’t find PBDE violations in any of products we tested.

The bad news is some of the replacement flame retardants we detected are still toxic but not yet regulated. And just as concerning are the indications that substituted chemicals may be toxic, but due to the proprietary nature of the chemical formula, we can’t identify or quantify them. This is why we cannot stop at banning toxics but must also find ways to assure that manufacturers move toward safer alternatives.

The lab could not identify the brominated compounds in 54 samples that screened positive for bromine using x-ray fluorescence. This suggests more brominated compounds than what we tested for are in use, which is a problem because we may not have information about health effects.

Ecology also found that eight samples from children’s products contained flame retardants above the CSPA reporting limit. We have notified manufacturers and are working to ensure compliance.

Future work on flame retardants

These results show progress and a willingness among the manufacturing community to follow laws. However, the use of regrettable substitutions shows we still have work to do.

Fortunately, the Washington State Legislature agrees and has provided further funding for Ecology’s work on flame retardants and safer alternatives. They’ve requested a report by December 2014 recommending whether other flame retardants should be banned in children’s products and furniture.

Manufacturers and others interested in learning more about alternatives assessments for finding safer chemicals are invited to register for a workshop on July 9.

Janicki Industries scores triple win: A P2 success story

Janicki Industries, a composite fabrication company, scored a triple win on the preventing pollution (P2) scoreboard in 2013. They cut their dangerous waste by 20,000 pounds, saving $50,000 in the process, and improving their employees’ working conditions!

“It’s a lot cleaner environment for employees,” said Darren Wilson, Janicki’s Environmental Health and Safety Officer.

Janicki produces large-scale, high-precision molds and prototypes in its Hamilton and Sedro-Woolley facilities. They make templates in the Sedro-Woolley shop and use those templates to produce final products from carbon-fiber fabric and resin at the Hamilton shop.

Lower styrene emissions from process changes

Janicki lowered their styrene emissions at the Sedro-Woolley shop by switching to low-pressure impingement-spray equipment for resin.

Previously they used high pressure and a single nozzle for spraying. That pressure wasted material because it created an atomized “mist” of resin around the spray stream. Now, two nozzles using lower pressure “impinge” the spray streams into each other. This creates a “flow coat” without the wasted mist.

The vacuum-infusion system they use for some products also helps the air quality. Workers lay the carbon-fiber fabric on the template, then bag and seal the entire item. A vacuum pump sucks epoxy resin into the bag and throughout the fabric. The only emission is the exhaust from the vacuum pump.

“It looks like a shop where they’re [just] putting tools together. You’d hardly notice that they’re using resins,” said Wilson.

Shop towels dropped from two drums per day to one drum per week

Workers use hundreds of shop towels for cleaning the tools and products. At one time Janicki was filling two 55-gallon drums with solvent-soaked disposable rags every day. This was all dangerous waste they had to manage and dispose of at considerable cost. Switching to reusable rags has cut the waste to one drum per week. An industrial laundry cleans and returns the reusable rags.

Special orders can create more waste

The company also reduced their hazardous waste by instituting a better system for buying and storing materials. Janicki is a custom shop, where customers set the specifications. Each job is a special order and may use special supplies. They frequently had to dispose of off-specification materials. The materials also have a shelf life and may expire before the company can use them up. This added to the company’s dangerous waste. Their new system is “still a work in progress,” according to Wilson, but it is already helping the company cut back on the amount of dangerous waste they create.

Tackling Toxics: This spring, green chemistry is growing
